									<p><span style="line-height: 1.5em;">What is a contingent offer? There are many types of contingencies that accompany an offer.  We are specifically going to be talking about offers that are contingent upon the Buyer having to Sell their home before they can buy the home that they want to purchase.  In other words, in order for the buyer to perform and close escrow they have to sell their home in order to do so. </span></p><p>Things to Think About:</p><p>1. When countering an offer that is Contingent upon the buyer selling their home in order to purchase, the seller should always counter the number of days that the buyer has to actually get their home into contract.  For example, if the buyer does not have their home in contract (meaning they have procured a buyer for their home) within a specific timeframe, the seller would reserve the right to cancel the contract and move on.</p><p>2. The seller should understand that even if the buyer removes their Contingency to “Sell” their home, that removing that contingency really isn’t even worth the paper it is written on until the home the buyer is trying to sell actually CLOSES. Why? They CANNOT perform without the funds from the home that they are selling.  However, if the buyer is able to secure a bridge loan or borrow the money to close on their new home, then it would be safe for them to remove this contingency.  Be sure, they show you Proof of such funds.</p><p>3. If the buyer does remove their contingency and at a later time are NOT able to perform, it is very difficult to retain their deposit.  If the buyer does not voluntarily give up their deposit and let the Escrow Company know that they are “Willing” to give up their deposit to the seller, the Title Company cannot legally give the deposit to the seller without the written consent of the buyer.  The seller would then have to take the buyer to court and show that they did “Suffer” financial damages and or loss in order to retain that deposit.  Also, without a “Release of Contract” the seller cannot sell their home to another potential buyer, which is also a risk.</p><p>4. When countering this type of Contingency, the seller should have a clause in the counter offer or contract that states that if another offer comes in, the seller reserves the right to cancel the offer in a very quick time frame.  For example: within 24 hours.  Also, it is very important that they require the buyer not to just remove the contingency, but to also show the buyer has the “Funds” to close the escrow without having to sell their home.  If they do not have the funds to close the escrow without selling their home, the seller needs to make sure the buyer knows they will still cancel the contract.  Removing the contingency is not enough, the seller needs to require the buyer to put their money where their mouth is, so to speak.</p><p>5. Lastly, a seller should know and understand that taking a Contingent offer is much riskier than taking a Non-Contingent offer.  If the seller has the choice between taking an offer that is Contingent vs. a Non-Contingent offer, they should take the Non-contingent offer over the Contingent offer.  Remember, there are three parties to the transaction instead of just two when you have this type of contingency.</p><p>Please don’t hesitate to call or e-mail with any questions or comments.  We are here to help at any time. <a href="https://g5mv2etda4.wpdns.site/" rel="nofollow noopener" target="_blank">www.KristaHomes.com</a>.  Krista Mashore 925-325-4663</p>								</div>

									<p>First off you may be asking&#8230;&nbsp;<strong>What are Closing Costs</strong>??&nbsp; Many people think that closing costs consist only of their down payment.&nbsp; Closing Costs are other costs associated with the purchase of a home that need to be paid before escrow can close.&nbsp; These costs are in addition to the down payment. Closing Costs consists of many different things:</p>
<p><em><strong>Escrow Fees-</strong></em> One fee that is called an escrow fee.&nbsp; Escrow is a conduit between the buyer, seller, agents and lenders.&nbsp;&nbsp;The primary task of the Escrow Company is the holding of&nbsp;the money and the coordination&nbsp;&amp; distribution of funds.&nbsp;This fee is&nbsp;paid to the Escrow Company and its consists of processing the file, coordinating issues with title, and the&nbsp; drawing of loan documents.</p>
<p><em><strong>Settlement Fee-</strong></em> Settlement fees are&nbsp;comprised of the&nbsp;&nbsp;Escrow fee, but it includes doc prep fee, courier fee, signing fee, e-mail fee and loan tie&#8217;in fees.</p>
<p><em><strong>Title Fees-</strong></em> Title Insurance policy protects the&nbsp;Real Estate Owner or Lender against any loss or damage that they could experience due to liens, encumbrances, or defects to the said property.&nbsp;&nbsp;&nbsp;There are two&nbsp;types of &nbsp;Title Fees.&nbsp;&nbsp;1. Owner&#8217;s Title Policy &nbsp;2. Lenders Title Policy. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;</p>
<p>&nbsp;1. <em><strong>Owners Title Policy-</strong></em> Protects your&nbsp;ownership/title &nbsp;of the home the buyer acquires.&nbsp; Owners Title policy insures the ownership of the property to the buyer. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;</p>
<p>2. <em><strong>Lender&#8217;s Policy-</strong></em>ensures the lender on the property if there is a lender involved.&nbsp; Lender&#8217;s Title basically ensures that they are the true owner. An Example of how title could help would be if there is a legitimate claim for the property Title would cover the fees associated with it.&nbsp; Any type of Claim of Ownership to the property is basically what the Title Company will cover.</p><p><br></p>
<p><em><strong>County Transfer Tax-</strong> </em>which in Contra Costa County currently is $1.10 per $1,000. However, typically every&nbsp;County has one or more cities that the traditional amount of Transfer Tax is higher, like the City of Richmond&nbsp;currently is $7.00 per $1,000.&nbsp; For example: If you are selling a home for 500,000 your Transfer Tax would be $550.00 which is typically paid by the seller.&nbsp;&nbsp; All Counties Transfer Tax differs and it&#8217;s important to point out again that there could be certain city&#8217;s within a County whose Transfer Tax differs.</p>
<p><em><strong>Property Taxes-</strong></em>&nbsp;Typically the new owner will start to pay the Property Taxes from the&nbsp;day that&nbsp;escrow closes and going forward.</p>
<p><em><strong>Lender’s Fees</strong></em>&#8211; Fee&#8217;s the Lender of which the loan is being purchased and the loan is being transfer from have fees associated with this.</p>
<p><em><strong>Payoffs and Reports</strong></em> <em><strong>Commission:</strong></em>&nbsp;Fee&#8217;s typically paid by the Seller for&nbsp;both the&nbsp;Selling Agent (that is the agent who brings in the buyer for the sale of the home, and the Listing&nbsp;Agent, the agent that&nbsp;Lists the home. Typically, and I say typically because depending on the climate of the market you need to remember that ANYTHING is Negotiable.&nbsp; Buyer and seller can agree on whatever terms they want (as long as they are not fraudulent or illegal). <em><strong>&nbsp;</strong></em></p>
<p><em><strong>Buyer</strong> </em>will pay for BOTH Escrow and Title Fee&#8217;s (Owner&#8217;s Policy)</p>
<p><em><strong> Seller</strong></em> will pay for the County Transfer Tax. The fee&#8217;s and who typically pays for what IS NOT THE case if the market is a favoring either the buyer or the seller.&nbsp; In a Seller&#8217;s market, the seller has the control and can request the buyer to pay any and all fees associated w/ the Closing Costs.&nbsp; The reverse is true as well.&nbsp; However, you need to remember that your Real Estate Professional will advise you on the climate of the market, status of how many offers are in hand, and any other material facts that will help both&nbsp;the buyer and seller know how to proceed with offers and counter offers.</p>

<p>The majority of real estate firms responding to a survey from the&nbsp;<a href="http://www.realtor.org/" target="_blank" rel="noopener nofollow">National Association of Realtors</a>&nbsp;(NAR) expect profits—and competition—to heat up over the next year as the housing market continues to look up, the association.</p>
<p><span style="font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight ); font-size: 1rem;">NAR&nbsp;released on Tuesday its 2013 Profile of Real Estate Firms, which examines the makeup of companies, their offerings, and their expectations for the industry. This year’s report was based on a questionnaire mailed to a national sample of 121,931 executives at real estate firms; the survey’s response rate was 5.5 percent.</span></p>
<p>Out of those firms that responded, 84 percent were independent, non-franchised companies, while 13 percent were independent franchises; the remainder were subsidiaries of a national or regional corporation. The majority—approximately 80 percent—specialize in residential brokerage, with commercial brokerage and residential property management the most common secondary functions.</p>

<p>Sixty-nine percent of respondents said they expect profitability to rise over the next year, and most are preparing to battle for every dollar.</p>
<p>“Two out of three real estate firms expect competition in the marketplace to increase, both among firms and nontraditional market participants,” said Paul Bishop, NAR’s VP of research. “Because real estate is an entrepreneurial field, some experimentation in business models is likely when the market is in a recovery phase.”</p>
<p>In response, many firms are bolstering their ranks with new recruits.</p>
<p>“Although conditions vary around the country, 45 percent of real estate firms are actively recruiting agents, largely due to growth in their primary business,” saidNAR&nbsp;president Gary Thomas.</p>
<p>Out of those that are currently on staff at these firms, 72 percent have an academic degree. More than eight in 10 firms have licensees with professional certifications or designations, and more than six out of 10 provide training and education programs for their staff or sales agents. The typical firm requires new agents to receive a median of 21 hours of training or&nbsp;<a id="_GPLITA_0" title="Click to Continue > by CouponDropDown&#8221; href=&#8221;http://www.dsnews.com/articles/real-estate-firms-anticipate-increased-profits-competition-2013-09-11#&#8221;>continuing education</a>&nbsp;each year, while experienced agents must receive 12 hours.</p>
<p>Taking a look at potential obstacles ahead, Thomas noted “six in 10 firms cite profitability, 44 percent identified local or regional economic conditions, and 42 percent are concerned about both maintaining sufficient inventory and keeping up with technology.”</p>

									<p><span style="font-family: arial,helvetica,sans-serif; font-size: medium;">When selling your home to a perspective buyer it is CRUCIAL that you disclose anything and everything regarding your home. 5 Reasons why Disclosure so imperative when selling your home??</span></p><p>1.<strong> It will help keep you out of court:</strong>  Buyers and sellers love to get into litigation. Disclose anything that you have done to the property.  It is less likely that you will loose in litigation if you have let the buyer know about all issues relating to the property.</p><p>2. <strong>Don&#8217;t give the buyer a reason to back out:</strong>  Once a buyer feels that you are &#8220;Hiding&#8221; something from them  or not disclosing material facts, buyers tend to worry  or question if there is anything else that they should know about or that you may be withholding.  If our not sure what should or should not be disclosed,  be sure to speak to your Real Estate Professional and ask them their opinion on what should be disclosed.</p><p>3. <strong>It can open up or extend Contingency Timeframes:</strong>  Be sure to disclose all relevant information during the specified time frames<strong>.</strong>  Be sure to disclose all of the information during the time frame you have in the contract.  It actually is best to do the disclosures before the home goes on the MLS.  You should have all of the disclosures, reports, etc. listed on MLS so that when a buyer is making an offer, their offer is based off of the reports and disclosures that they have already seen.  If you forget to disclose something or something comes up after the buyer has removed their contingencies, you will open back up the contingency period w/ the new items that you are disclosing or letting the buyer know about.   This gives the buyer the opportunity to back out during and keep their deposit if they do.  Any new disclosure  that is given to the buyer to sign after the contingency time period has expired, will open up the contingency period again, thus allowing the buyer the opportunity to use the new information that was disclosed to back out if they so wish.</p><p>4. <strong>Buyer knows what they are buying: </strong>You want your buyer to know upfront what they are buying.  The sooner they know about anything and everything the property has to offer, the sooner you can close the escrow and move on.  If you don&#8217;t disclose material facts and the buyer finds out things on their own, they can back out of the property and this will cost you time and money.  Your home may end up going back on the market thus looking like your home has taken longer to sell.  This of course</p><p>5. <strong>Facts may/may not add  Value or Decrease the Value of a home:</strong> When selling you want to disclose what may or may not add value to a home.  If your home is 1 mile from the nearest winery, you may feel that that is an attractive feature to the buyer and you may consider that it adds value to the property.  However, a buyer may think that a winery so close may increase the likeliness of a DUI collision and more car accidents.</p><p>Bottom line is that you as a Seller may not know what or what not to Disclose when selling your home.  It is very important that you speak with an experienced licensed Broker/Realtor when listing your home to know what should or should not be disclosed when selling.  My advice is you can never disclose to much, over disclosure is always better than less.</p><p>Watch my video below!</p>								</div>
